This privacy policy describes the personal data processing practices for SkillView in accordance with Article 13 GDPR (EU Regulation 679/2016). It is owned and administered by the Provider and processes personal data in accordance with this policy.
This document aims to inform you about the type of personal data the Provider collects from you, how and where we use this data, how we understand to protect this data, who has access to it and what rights you have from the point of view of the processed data.
Definitions
Provider - S.C. Skillview IO SRL, headquarters in Cluj-Napoca, Str. Henri Barbusse 44-46, floor 6, registered at the Trade Register Office under no. J12 / 4208/2017, CUI 37852885, email contact@skillview.io.
SkillView: the website www.skillview.ro, as well as all the services accessible on it, including the SkillView platform or application.
Beneficiary: the legal entity that can access the results of a test on SkillView.
User: an individual over the age of 16 who creates an account on SkillView to take tests and manage his or her test results, or an individual who is invited by a Beneficiary to take one or more tests on SkillView via a publicly available link.
Tests - aptitude tests available on SkillView for any User.
Throughout this document, all terms defined in the GDPR will have the meaning specified in this Regulation.
1. About us
As a personal data controller within the meaning of EU Regulation 2016/679 (GDPR) and administrator of SkillView, SkillView Io SRL respects the personal data of its users and ensures the security of personal data provided by users.
The Provider complies with the Romanian and European legislation in force in the field of personal data protection and collects personal data only for the purposes determined below.
The purpose of personal data processing is to provide services on SkillView (with all related activities such as possible order processing, payment, invoicing, contract notifications, etc.), support services and customer relations and marketing activities for the needs of SkillView, as appropriate.
The legal grounds for processing this data are:
● execution of the contract and preliminary steps for this contract (art. 6 (1) b GDPR) - for the data collected through the user registration forms, account, order form or data received as a result of customer relations services;
● legal obligations (art. 6 (1) c GDPR) for the data necessary for invoicing, if applicable;
● the legitimate interest (art. 6 (1) f GDPR and law 506/2004 art. 12 (2)) for the data used for marketing for current customers (beneficiaries and users), the security of the own site and / or the data used for Skillview optimization.
● consent (art. 6 (1) of the GDPR) for the data used for marketing for site visitors (eg newsletter subscription, marketing cookies, etc.)
2. What personal data we collect and who has access to your data.
SkillView collects information from its users in three ways: directly from the user, technical data from the interaction of computer systems with SkillView, and through cookies.
The specific case of data processed from users without a SkillView account is specified at the end of this chapter.
2.1. Personal data collected directly.
When you access SkillView or when you create an account or place an order, we may ask you for your last name, first name and / or email address, as well as other data required for contracting or billing.
This data is kept over a period of 5 years from the last interaction with SkillView (login to the account, accessing the test link, viewing results, etc.).
The data in the invoices is kept for a period of 10 years, there being a fiscal legal obligation in this respect.
If you do not provide us with this information, we will be unable to honor your order.
In case you choose to create an account through Google or Facebook Login, the connection can also transfer information to Facebook or Google, which can also automatically collect information such as your IP address, information about your browser and device and the address of the web page you visit on our site. Also, the login function may place and read cookies from these providers, and this functionality and use of this login is governed by the Facebook or Google data processing policy.
Also, when you access customer support services or fill out a form on the site, we may ask you for an email address or phone number. This information is kept for a maximum period of 10 years. This data is used for the purpose of providing the services and tests on SkillView, contacting you, establishing the necessary data for the contract or billing, or the contact person and / or to resolve your complaint / request.
We may request other data that may constitute personal data only to the extent to which it is necessary for these purposes.
As well as this, when you subscribe to our newsletter, please provide us with an email address, name and other information necessary to personalize the communication with you.
This data is kept until the consent is revoked or until your activity shows us that you are no longer interested in our communication.
When you make a payment, it is made by the payment processor, so bank information is transmitted directly to it and is not processed by SkillView. In this situation, personal data processing policies are available on the websites of these partners.
2.2. Technical data
2.2.1 When visiting SkillView
When you visit a website, regardless of the device used, you disclose certain information about yourself, such as your IP address, the time of your visit, the place where you entered our sites, the pages visited. SkillView, like other operators, records this information for a specified time. SkillView uses external traffic analysis services, such as Google Analytics or Hotjar. This data is kept for a period of 50 months to improve the services provided.
This data is used exclusively by SkillView to improve our site and services, but also to ensure the security of our site.
2.2.2 Testing
Also, when you receive an invitation or take a test, we may retrieve certain technical data, such as your IP, your interaction with your browser (e.g., if you leave the window where the test takes place), the speed of response, or other data and meta -similar technical data.
This data is collected exclusively for the purpose of detecting potential fraud during testing and improving our testing. It may be used or presented together with the test results and may be accessible to the Beneficiaries, as appropriate. This data is kept for a period of 120 months to improve the services provided.
2.3. Cookies.
SkillView may use cookies for site functionality (account, language, etc.) but also to facilitate the storage and tracking of your preferences, or to optimize our sites, including personalization, or for marketing.
For external SkillView services that place third-party cookies when browsing SkillView sites, their purpose is marketing, traffic analysis or other personalization types, such as Google Analytics for traffic analysis, or Google and Facebook for optimizing authentication services.
Most browsers are set to accept cookies automatically. However, if you do not favour this, you can either reset your browser, or have it notify you whenever you receive a cookie, or even refuse to accept cookies. However, you should be aware that some sections of our site will not be able to be viewed normally if you have set your browser to reject cookies.
Users who do not want to use cookies can use their preferred browser settings to delete or block them or use plugins that do the same.
This data is kept for a maximum period of 120 months.
2.4 Users without a SkillView account
In the case of users who take a test on SkillView without having a SkillView account, they have access to this feature through a unique link sent by a Beneficiary. The beneficiary can send the access link directly or can abilitate SkillView to send the direct invitation to the test on his behalf.
In this case, personal data is processed by SkillView and the Beneficiary as associated operators in order to allow a user to make directly the aptitude tests available on SkillView and to allow him access to the result of these tests and their administration, if he wishes.
Thus, the Beneficiary has the obligation to use an appropriate legal basis for the processing of personal data of Users in order to send the invitation and allow a test without an account.
In this case, the means of processing are limited to the testing services available on SkillView and the technical data processed by it.
At the end of the test, you will have the right to open an account on SkillView, where you will have direct access to your test results and their administration.
In accordance with Article 26 of the GDPR for this specific processing you can exercise your rights with respect to and in relation to each of the operators.
3. Data hosting
The information, including personal data, received on our servers will be recorded, used, stored and organized on protected servers, where SkillView is hosted, as well as on any other media that allow such operations, in optimal security, by appropriate means. For the secure hosting of personal data, we use the services of specialized companies within the European Union, which act as persons authorized by SkillView. You can find more details in art 6.
4. How can we correct errors in the data collected from you?

Under the SkillView Terms and Conditions, your account cannot be transferred to another user.
5. Your rights
According to the GDPR, you have the right of access, the right to rectification, the right to delete data, the right to restrict processing, the right to data portability and the right to opposition.
For data collected by consent, you have the right to withdraw consent at any time.
To exercise these rights, you can send by e-mail a request to contact@SkillView.ro regarding the personal data collected by us.
As well as this, you have the right to file a complaint with a supervisory authority or to take legal action.
6. Who has access to your information
SkillView may transmit or allow access to this data to third parties (called appointees) for the purposes mentioned above, such as:
● IT service providers for SkillView
● SkillView hosting provider
● customer support service provider
● payment processor
● marketing companies (including newsletter)
● traffic analysis, as detailed in this document.
These companies are obliged to use this data securely and exclusively for the purposes specified by SkillView. They only have access to the personal data which is strictly necessary for the provision of the service established by SkillView and may not use personal data for their own purposes.
All the proxies we work with are part of the European Union, and those in the United States are enrolled in the United States - European Union Privacy Shield program.
Out of obligations of confidentiality, security and protection of commercial interests, we prefer not to publish the exact names of these third parties, but only the categories of appointees. The list of persons empowered with contact details may be made available to the competent authorities or interested users, in accordance with the law.
In case of special situations. SkillView may disclose personal data when expressly provided by law, when requested by a competent authority or when this is necessary to protect the rights and interests of SkillView.
You will also be able to give access to your test results to various Beneficiaries who request this in SkillView. This access is not given by default, but only actively by you - pressing the send button to the Beneficiary means your consent in this regard. This consent may be withdrawn at any time in accordance with Article 5. Any processing and use of data and information received by the Beneficiary is the Beneficiary’s sole responsibility.
In the case of users without a SkillView account, in accordance with those mentioned in Art 2.4., the test results are automatically available to the Beneficiary who sent the invitation to the test.
7. Final provisions
The policy regarding the processing of personal data must be interpreted together with the SkillView Terms and Conditions of Use, if applicable, and are subject to the laws in force in Romania.
This policy on personal data processing was adopted today, 09.06.2020 and in the future, whenever we change it, we will publish a new version on the first page of the SkillView.ro site and send information in this regard.
